A new bill authored by State Rep. Cain seeks to revise the use of average enrollment in the Texas public school finance system to better address funding adjustments and enrollment calculations, according to the Texas Legislature website.

The bill on Courts and Crimes category, introduced as HB 82 during the 89(2) legislative session on Friday, Aug. 15, was formally listed with the short title: ’Relating to abortion, including civil liability for distribution of abortion-inducing drugs; making conforming changes and harmonizing conforming provisions; authorizing a private civil right of action’.

In essence, this bill amends various sections of the Texas Education Code to revise how average enrollment is used in the public school finance system. It defines “average enrollment” as either the average number of students enrolled in a district or, in certain cases, half of that number for districts operating specific prekindergarten programs. The bill provides guidelines for funding adjustments in cases of enrollment declines due to military base changes or other factors, and allows the commissioner to adjust enrollment figures for districts affected by disasters or with significant migratory student populations. The bill takes effect on the 91st day after the legislative session ends, repealing certain outdated provisions.
